1. Description of Service
Arca is a professional productivity tool designed for therapists and mental health professionals. The app provides on-device speech-to-text (STT) transcription and local encrypted storage for session notes.
2. Professional Responsibility & Compliance
Arca is a tool to assist in the documentation process.
- User Responsibility: As a user of Arca, you acknowledge that you are a licensed professional and are solely responsible for ensuring that your use of the app complies with your local jurisdictional laws, ethical guidelines, and institutional policies (including but not limited to HIPAA in the US or KVKK in Türkiye).
- Patient Consent: You are responsible for obtaining all necessary consents from patients or clients before recording any session or audio.
3. Data Storage & "Zero-Cloud" Policy
Arca operates on a "Privacy-First" model.
- No Cloud Backups: You acknowledge that Arca does not upload or back up your audio recordings or transcripts to any server. All clinical data is stored locally on your device.
- Risk of Data Loss: If you delete the application, lose your device, or if the device experiences a hardware failure, your audio and transcripts will be permanently lost. Arca and its developer cannot recover this data.
- Manual Backups: It is your responsibility to export and secure your transcripts to your primary professional record-keeping system.
4. AI Accuracy Disclaimer
The transcription provided by Arca is generated by an on-device machine learning model.
- Accuracy: Transcription accuracy can be affected by audio quality, accents, background noise, and technical limitations.
- Review Required: Arca is not a substitute for professional clinical judgment. You must review and edit all generated transcripts to ensure they accurately reflect the session before including them in any official clinical record.
5. Payments, Credits, and Subscriptions
Arca utilizes RevenueCat for processing in-app purchases and subscriptions.
- Session Credits: Credits are consumed upon the initiation of a transcription session. Consumed credits are non-refundable.
- Subscriptions: "Plus" subscriptions provide unlimited transcription for the duration of the billing cycle. Subscriptions automatically renew unless canceled through your App Store or Google Play account settings.
- Restore Purchases: If you switch devices, you may use the "Restore Purchases" feature to regain access to your remaining credit balance and active subscriptions.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Abdussamed Şahin and Arca shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses resulting from:
- Your use or inability to use the service.
- Any errors or inaccuracies in the AI-generated transcription.
- The loss of clinical data due to device failure or app deletion.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Türkiye, without regard to its conflict of law provisions. Any legal action or proceeding related to Arca shall be brought exclusively in the courts of İstanbul, Türkiye.
8. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any changes by updating the "Last Updated" date at the top of this page. Continued use of the app after changes are posted constitutes acceptance of the new terms.
